Escott v. Mastin, Judgment on Appeal, 1842
The judgment of the Judicial Committee of the Privy Council in the case of Escott against Mastin on appeal from the Arches Court of Canterbury; From
the shorthand notes of Mr. Gurney: n.a., 17p, London, Blenkarn, 1842. (This is a case where the Judicial Council up held a ruling by the Court of
Arches, the ecclesiastical court, of Canterbury inflicting a penalty on an Anglican minister who refused church burial to a dead infant on the grounds
that, the infant having been given an emergency baptism by a lay person, something normally forbidden, it was not a Christian. The court ruled that
baptism by lay persons, although forbidden and even sinful, are valid in emergency situations. Subjects: England, ecclesiastical law, baptisms and withheld
burials.)
