1733, Opinion of Chief Justice on jurisdiction in equity
1733 dissenting opinion and argument of Lewis Morris, the Chief Justice of the Province of New York, concerning the jurisdiction of the Supreme Court
of said Province to determine causes in a course in equity. A copy of this dissenting opinion was printed in New York after Gov. Cosby so requested,
despite having been successful in the case, Cosby v. Van Dam. Of note, the attached letter following the opinion further angered Cosby and led to
Morris' removal. In part, Morris stated, "If judges are to be intimidated so as not to dare to give any opinion, but what is pleasing to the Governor,
... the people of this province ... may possibly not think themselves so secure in either [freedom and independence] as the laws of his Majesty
intended they should be." (Source of the digitized copy: New York Historical Society Library).
