Forty-fourth Legislature. House. No. 45. The Committee on the Judiciary submitted: An Act additional concerning railroads, 1865. When a railroad
was unable to make a deal for depot property it wanted, it could ask the Railroad Commissioners to look at the situation. If the Commissioners
thought the space was necessary for the railroad, it could authorize a taking. Private homes, meeting houses, and burying grounds were excepted.
