Wm.H. Morrison, 1885. (Prior to 1839 appeals from decisions of the Commissioner of Patents went to a Board of Examiners appointed by the Secretary of
State. By act of 1939 this appeals jurisdiction was vested in the Circuit Court of the District of Columbia. It remained with that court and its
successors, the Supreme Court of the District of Columbia {est. 1863} and the Court of Appeals of the District of Columbia {est. 1893}. As the author explains
in the preface: “In their anomalous relations with the Executive Department, the judges do not exercise the purely judicial functions of a court of
record. The judgment is recorded in the Patent Office and controls the further proceedings of the Commissioner, but does not preclude any person
interested from renewing the contest in another forum.” MacArthur's first volume compiles the decisions of the named courts up to 1859. A subsequent volume,
carrying the coverage forward, was contemplated but never materialized. The author’s title refers to a Patent Office process, namely the Interference
Proceeding, which was a hearing before officers for the purpose of determining the relative priority of two conflicting inventions. The decisions of
these interference proceedings provided the principal fodder for appeals to the DC Circuit {after 1863 Supreme} Court.)
