Justice Dept., Attorney General Opinions, 1790-1982
Official opinions of the Attorneys General of the United States advising the President and heads of departments in relation to their official duties:
Vol. 1-43, 1791-1982, Wash., GPO, 1852-1977, plus four index volumes covering 1789-1974, all published. (The Judiciary Act of 1789 created the Office
of the Attorney General {A.G.}, although it denied the holder cabinet rank. The post, at that time a one-person part-time position, was first held by
Edmund Randolf, a distinguished Revolutionary War patriot, delegate to the Constitutional Convention, and former Governor of Virginia. The office
grew in importance over the years, so that under the Judiciary Act of 1870 the A.G. became a cabinet officer as head of the Department of Justice and
chief law enforcement officer of the Federal Government. Among his many duties the A.G. represents the United States in legal matters generally and gives
advice and opinions to the President and to the heads of the executive departments of the Government when so requested. The first five volumes of
this run, edited by Robert Farnham and published in 1852 consisted of a retroactive compilation of A.G. opinions from the first recorded opinion issued
in 1791 to 1852. Thereafter volumes were published periodically in a regular series as a sufficient number of opinions were accumulated. This series
ended when, in 1977, under statutory authority {28 U.S.C. § 510}, the A.G. delegated the responsibility for preparing the formal opinions of the A.G. to
the Justice Department’s Office of Legal Council. The decisions issued by the latter office are published in a series entitled Office of Legal
