1841-03-01, Opinion on the term "foreign paupers" to include prisoners
Senate No. 43 On March 1, 1841, three Justices of the Supreme Judicial Court, in response to a request, sent an opinion. Did the term "foreign
pauper" apply to aliens who were prisoners in a House of Correction and could not pay for their maintenance? The Justices examined the statutes re
Houses of Correction and alien prisoners. They decided that in 1839, the state declined to support any persons in jails or Houses of Correction--that
duty fell to the counties. Therefore, any person who could not pay their own way had to be supported by the counties. "Foreign paupers" had no real
