1824-01-21, Opinion on citizenship
The Massachusetts Senate, in June 1823, asked about the citizenship status of George Phipps, pauper. The Supreme Court responded with an opinion
concurred in by three justices, and signed by Isaac Parker, but retained the right to reconsider the question if another suit were brought. Mr. Phipps
had come to Massachusetts as a British soldier, but apparently deserted very soon to the American side. He subsequently lived in an unnamed town,
owned real estate, and paid all relevant taxes for 45 years. The Court pointed to a Massachusetts law of 1777 that said all persons abiding within the
state and deriving protection from the laws, owes allegiance to the state and is a member thereof. So, yes, Mr. Phipps is a citizen, and the question
would not have arisen at all had he not become a pauper. (Digitized from a microfilm copy of title originally held by the Massachusetts State
