This thesis discusses the problem of judge advocate legal malpractice. It explores the civilian standards of malpractice and synthesizes a special
standard relevant to judge advocates. It then analyzes the possible bases of malpractice which a judge advocate may face in the operation of his law
office. Liability of the United States and the individ­ual judge advocate is discussed concomitant with defenses available to each. Finally, a
legislative proposal is made which would have the effect of limiting liability of the in­dividual judge advocate and make the Federal Torts Claims Act the
exclusive remedy for military legal malpractice.
