This thesis discusses the problem of judge advocate legal malpractice. It explores the civilian standards of malpractice and synthesizes a special standard relevant to
judge advocates. It then analyzes the possible bases of malpractice which a judge advocate may face in the operation of his law office. Liability of the United States and the individual judge advocate is discussed concomitant with defenses available to each. Finally, a legislative proposal is made which would have the effect of limiting liability of the individual judge advocate and make the Federal Torts Claims Act the exclusive remedy for military legal malpractice.
