|
The proposed separation of judicial and executive duties in India; Memorial from the Rt. Hon. Lord Hobhouse, the Legal Member of the Viceroy’s Council (joined by nine other legal luminaries, mainly judges, serving in British India); Together with two appendices: n.a., 55p, London, British Committee of the Indian National Congress, 1899. (Lacks TOC & index. At head of title: Congress Green-Book No. III. The main brief advocating reform is covered in pp. 1-12. Appendix A, pp. 13-29, describes the workings of the lower judicial system where the magistrates were dependent for promotion to higher executive positions upon their superiors, giving the latter undue influence on their subordinates’ actions while they were exercising their judicial roles. Appendix B, pp. 61-55 provides summaries of actual cases that appeared to be decided erroneously due to that “command influence.” The print text of this title was scanned from Lincoln’s Inn Library pamphlet volume MP 69.)
