Description: by Daniel J. Capra, Fordham Univ. Law Sch., iv+48p, Wash., FJC, 1998. (In the 1970s the Advisory Committee on Evidence prepared a complete draft of proposed Federal Rules of Evidence, which draft was approved by the Judicial Conference of the U.S. and the Supreme Court, and served as a model for the rules subsequently enacted by Congress. Hence, the Advisory Committee Notes constitute one source of the “legislative history” of the rules and are widely referenced for that purpose. However, since Congress did not enact each rule in precisely the form recommended by the committee, and because other inconsistencies or errors exist in the Notes, this publication was issued to provide guidance where the Notes may mislead.
